1. Acceptance of Terms

By downloading, installing, accessing, or using the CaribSafe mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.


2. Description of Service

CaribSafe is a safety and security mobile application designed to help users:

  • Access emergency services quickly
  • Share location with trusted contacts
  • Report and receive alerts about safety incidents
  • Track journeys and set check-in timers
  • Stay informed about safety in their area

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that:

  • You are at least 13 years old
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • You will not use the App for any illegal or unauthorized purpose

4. User Accounts

4.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your account credentials secure
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Logging out of your account when using shared devices
  • Notifying us immediately of any security breaches

5. Acceptable Use

5.1 Permitted Use

You may use the App only for lawful purposes and in accordance with these Terms. You agree to:

  • Use the App in compliance with all applicable laws
  • Provide accurate and truthful information
  • Respect the rights of other users
  • Report incidents accurately and responsibly

5.2 Prohibited Activities

You agree NOT to:

  • Use the App for any illegal purpose or in violation of any laws
  • Submit false, misleading, or fraudulent incident reports
  • Harass, threaten, or harm other users
  • Impersonate any person or entity
  • Interfere with or disrupt the App's functionality
  • Attempt to gain unauthorized access to the App or its systems
  • Use automated systems to access the App without permission
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App to transmit viruses, malware, or harmful code
  • Collect or harvest information about other users without consent

6. Emergency Services Disclaimer

6.1 No Guarantee of Response

IMPORTANT: CaribSafe is a tool to help you contact emergency services and notify your contacts. We do NOT guarantee:

  • That emergency services will respond to your calls
  • The speed or quality of emergency service response
  • That your location will be accurately transmitted
  • That notifications will be delivered to your contacts
  • That the App will function in all circumstances

6.2 Emergency Service Limitations

Network Dependencies: The App requires internet connectivity and may not work in areas with poor or no network coverage.

Device Limitations: The App may not function properly if your device is damaged, has low battery, or is in airplane mode.

Location Accuracy: Location services depend on GPS, Wi-Fi, and cellular signals, which may be inaccurate or unavailable.

Third-Party Services: Emergency services are provided by third parties (Police, Medical, Fire) and are not under our control.

6.3 Your Responsibility

You acknowledge that:

  • You should always call emergency services directly (911) in life-threatening situations.
  • The App is a supplementary tool, not a replacement for direct emergency calls.
  • You are responsible for ensuring your emergency contacts are accurate and up-to-date.
  • You should test the App's features to ensure they work on your device.

7. Location Services

7.1 Location Sharing

The App collects and shares your location when you:

  • Activate the SOS feature
  • Use journey tracking
  • Share location with emergency contacts
  • Report an incident
  • Enable location-based alerts

7.2 Location Accuracy

We do not guarantee the accuracy of location data. Location accuracy depends on GPS signal strength, network connectivity, device capabilities, and environmental factors.


8. Incident Reports

8.1 User-Generated Content

When you submit an incident report, you:

  • Grant us a license to use, display, and share the report (anonymized) with other users.
  • Represent that the information is accurate and truthful.
  • Understand that false reports may result in account termination.
  • Acknowledge that reports are shared with the community for safety purposes.

8.2 Content Moderation

We reserve the right to review, edit, or remove incident reports; remove false, misleading, or inappropriate content; suspend or terminate accounts that violate these Terms; and report illegal activity to law enforcement.


9. Intellectual Property

9.1 Our Rights

The App, including its design, features, content, and functionality, is owned by CaribSafe and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

9.2 Your Rights

You retain ownership of content you submit. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for the purposes of operating the App.


10. Premium Features and Subscriptions

10.1 Free Trial

We may offer a free trial period for premium features. The trial will automatically convert to a paid subscription unless cancelled before the trial ends.

10.2 Subscriptions

Subscriptions are billed in advance on a recurring basis.

  • You can cancel at any time through your device's app store settings.
  • Cancellation takes effect at the end of the current billing period.
  • No refunds are provided for unused portions of subscriptions.

10.3 Price Changes

We reserve the right to change subscription prices. We will notify you of price changes, and you may cancel your subscription if you do not agree to the new price.


11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

11.2 Limitation of Liability

To the maximum extent permitted by law, CaribSafe and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use or inability to use the App, emergency service failures, or inaccurate location data.

11.3 Maximum Liability

Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.


12. Indemnification

You agree to indemnify, defend, and hold harmless CaribSafe from and against any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your submission of false information.


13. Termination

13.1 Termination by You

You may stop using the App and delete your account at any time through the App settings.

13.2 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, engage in illegal activities, or misuse the App.

13.3 Effect of Termination

Upon termination, your right to use the App ceases, and your data will be deleted (subject to legal retention) or anonymized.


14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use constitutes acceptance of the new Terms.


15. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of [Your Jurisdiction]. Disputes shall be resolved through good faith negotiation, mediation, or binding arbitration.


16. Severability

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

Our failure to assert any right under these Terms shall not constitute a waiver of such right.

IMPORTANT REMINDER: CaribSafe is a supplementary safety tool. In life-threatening emergencies, always call 911 directly. Do not rely solely on the App for emergency assistance.
