By downloading, installing, accessing, or using the CaribSafe mobile applications or web portal (the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Services.
CaribSafe provides safety, compliance, and workforce tools designed to help users and properties:
You must be at least 13 years old to use the Services. By using the Services, you represent and warrant that you are at least 13 years old, have the legal capacity to enter into these Terms, will comply with all applicable laws and regulations, and will not use the Services for any illegal or unauthorized purpose.
To use certain features, you must create an account. You agree to provide accurate, current, and complete information; maintain and update your account information; keep your credentials secure; notify us immediately of any unauthorized access; and accept responsibility for all activity under your account.
You are responsible for maintaining the confidentiality of your credentials, all activity under your account, logging out on shared devices, and notifying us immediately of any security breach.
You agree to use the Services in compliance with all applicable laws, provide accurate and truthful information, respect the rights of other users, and report incidents accurately and responsibly.
You agree NOT to: use the Services for any illegal purpose; submit false, misleading, or fraudulent reports; harass, threaten, or harm other users; impersonate any person or entity; interfere with or disrupt functionality; attempt unauthorized access; use automated systems without permission; reverse engineer, decompile, or disassemble the Services; remove or alter proprietary notices; transmit viruses or harmful code; or collect information about other users without consent.
IMPORTANT: CaribSafe is a tool to help you contact emergency services and notify your contacts. We do NOT guarantee that emergency services will respond, the speed or quality of response, that your location will be accurately transmitted, that notifications will be delivered, or that the Services will function in all circumstances.
Always call emergency services directly in life-threatening situations. The Services are a supplementary tool, not a replacement for direct emergency calls. You are responsible for keeping your emergency contacts accurate and testing that features work on your device.
The Services collect and share your location when you activate SOS, use journey tracking, share location with contacts, report an incident, enable location-based alerts, or sign on/off duty. We do not guarantee the accuracy of location data, which depends on GPS signal strength, network connectivity, device capabilities, and environmental factors.
When you submit an incident report, you grant us a license to use, display, and share the report (anonymized) with other users, represent that the information is accurate and truthful, and understand that false reports may result in account termination. We reserve the right to review, edit, or remove reports; suspend or terminate accounts that violate these Terms; and report illegal activity to law enforcement. Employers using Portal, People, Ops, or Kiosk are responsible for the accuracy of employment, compliance, and roster records they submit.
The Services, including their design, features, content, and functionality, are owned by CaribSafe Ltd and protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you submit; by submitting it, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it for the purposes of operating the Services.
New Account Owners are offered a 30-day free pilot of CaribSafe. During the pilot:
In short: nothing converts to a paid plan automatically. You choose to subscribe — we don't charge you unless you tell us to.
From time to time we may offer discounted introductory pricing (such as a "Founding Partner" rate) to a limited number of properties. Where offered, the specific terms, duration, and any conditions (such as providing feedback or a testimonial) will be confirmed with you directly before your subscription begins.
Once you've actively confirmed a paid subscription, subscriptions are billed in advance on a recurring monthly or annual basis, as selected. You can cancel at any time; cancellation takes effect at the end of the current billing period; no refunds are provided for unused portions of a billing period, except where required by law.
CaribSafe is priced by module and plan. You may add or remove optional add-on modules (such as Hurricane Readiness or HR and Compliance) at any time; changes take effect immediately and are reflected in your next billing cycle on a pro-rated basis where applicable.
We reserve the right to change subscription prices for future billing periods. We will notify you of price changes in advance, and you may cancel before the new price takes effect if you do not agree to it.
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law, CaribSafe Ltd and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use or inability to use the Services, emergency service failures, or inaccurate location data. Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
You agree to indemnify, defend, and hold harmless CaribSafe Ltd from and against any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your submission of false information.
You may stop using the Services and delete your account at any time. We may suspend or terminate your account immediately if you violate these Terms, engage in illegal activities, or misuse the Services. Upon termination, your right to use the Services ceases, and your data will be deleted (subject to legal retention) or anonymized.
Staff accounts on People, Ops, and Kiosk are provisioned by the employer. Ending People app access is initiated by the staff member and completed by the employer's HR administrator in the CaribSafe Portal. Employment records the employer is legally required to keep are not deleted solely because app access is revoked. Users of other CaribSafe apps that offer in-app deletion may continue to delete their data from those apps as described in the Privacy Policy.
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use constitutes acceptance of the new Terms.
These Terms are governed by the laws of England and Wales. Disputes shall be resolved through good faith negotiation, mediation, or binding arbitration.
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
These Terms and our Privacy Policy constitute the entire agreement between you and CaribSafe Ltd regarding the Services.
Our failure to assert any right under these Terms shall not constitute a waiver of such right.
By using the Services, you acknowledge that you have read and understood these Terms, including the limitations regarding emergency services, and agree to use the Services responsibly.
IMPORTANT REMINDER: CaribSafe is a supplementary safety tool. In life-threatening emergencies, always call your local emergency services number directly. Do not rely solely on the app for emergency assistance.
